Is it legal to get paid in my US bank account while working from home in India?
noclue asked:
I was working in the US on a H1 vias whic has since beenexpired. So I want to continue working from India but want to get paid in my US account.
If this is legal, what are the tax issues? What documents/ forms do I need to fill up.
Thanks for the answers.
I’ll not be working as a employee, rather I’d be working as a independent consultant.
This will be similar to a 1099 emploment if I were in the US. So my employer will not deduct any taxes etc.
Based on Tax Guru’s answer, I’m a nonresident alien and hence liable to taxes to Indian govt.
I have a savings account in the US and earning some interest on it so do I have to file any taxes in the US? Or having a savings account is not legal for me?
Thanks.

It does not matter where you put your money. If you are earning money in the US you will need to file a US federal return. If you make interest on the money you have in the bank you might have to file a US federal tax return it depends on the interest that you make.

There’s no US problem; however, you may have to convince your employer not to withhold US tax. Money that you earn for performing services in India is not US source income. If you are still a US resident for tax purposes, you will still have to pay US tax on your earnings; however, if you are now a nonresident alien for US tax purposes, then you should not be subject to US tax on money you earn working in India even if the services are rendered to a US business.
You should consult an advisor in India regarding any Indian legal or tax issues.
